At Luke Bramhall Physiotherapy, we respect your privacy and are committed to protecting your personal information. This policy explains how we collect, use, and safeguard your data in accordance with the Protection of Personal Information Act (POPIA).

To provide effective physiotherapy services, we collect:

  • Personal identifiers: name, ID number, contact details, and home address.
  • Health information: medical history, diagnoses, and treatment records (Special Personal Information).
  • Financial information: medical aid details and billing information.

Purpose of processing

We use your information strictly for:

  • Clinical assessment and physiotherapy treatment.
  • Communication regarding appointments and home exercise programmes.
  • Processing claims with medical aids and debt collection if necessary.
  • Complying with legal and professional obligations (HPCSA).

Data security and retention

We implement high-level technical and organisational measures (such as encrypted cloud storage and secure filing) to prevent unauthorised access or loss. By law, medical records are retained for a minimum of 6 years, or longer for minors and matters under litigation.

Your rights

Under POPIA, you have the right to:

  • Access the personal information we hold about you.
  • Request the correction or deletion of inaccurate data.
  • Object to the processing of your information, though this may affect our ability to treat you.

2. Terms and Conditions

1. Professional standards

Luke Bramhall Physiotherapy operates in accordance with the scope of practice and ethical guidelines set by the Health Professions Council of South Africa (HPCSA) and the South African Society of Physiotherapy (SASP).

2. Appointments and cancellations

  • Cancellations: we require at least 24 hours' notice for cancellations.
  • Late cancellations: failure to provide notice, or a no-show, will result in a cancellation fee of 100%, as that time was reserved exclusively for you.

3. Payment terms and medical aids

  • Responsibility: while we may submit claims to your medical aid on your behalf, the patient remains ultimately responsible for the full payment of the account.
  • Rates: our rates are medical aid linked. Please confirm your available benefits with your provider before treatment.
  • Overdue accounts: accounts not settled within 30 days may be handed over to a debt collection agency, with additional costs for the patient's account.

4. Informed consent

By engaging in treatment, you acknowledge that:

  • Physiotherapy involves physical assessment and manual techniques.
  • Results cannot be guaranteed, as recovery depends on individual biological responses and adherence to exercise programmes.
  • You have the right to ask questions or refuse any specific treatment modality at any time.

5. Limitation of liability

Use of this website and our services is at your own risk. Luke Bramhall Physiotherapy shall not be liable for any indirect or consequential loss arising from the use of the website or information provided therein.

6. Governing law

These terms are governed by the laws of the Republic of South Africa.
